This document is an inseparable supplement to the current “VPS and Cloud Server Service Usage Policy” issued by VinaHost.
Its purpose is to further clarify the customer’s responsibilities when managing virtual servers, and to define specific actions considered abusive or prohibited, based on widely adopted international standards in the industry.
These regulations are designed to provide customers with a stable, safe, and fair service environment, while helping maintain the quality of VinaHost’s infrastructure and IP address reputation.
By registering for and using VPS/Cloud Server services at VinaHost, customers are deemed to have read, understood, and agreed to comply with all terms in this document, along with the existing service usage policies.
1. Customer Responsibilities
At VinaHost, we always encourage customers to take proactive measures to manage and secure their service resources.
We are committed to delivering high-performance and stable infrastructure. However, VinaHost clearly states that the safety, performance, and integrity of data on the virtual server (VPS) primarily depend on how customers operate and manage their services. After the service is delivered, customers are fully responsible for all activities occurring on their servers.
Key responsibilities include:
Account Security
Customers must ensure the absolute safety of their login information, such as passwords, access codes, and SSH key pairs, to prevent unauthorized access or misuse.
Server Management and Operation
After receiving access credentials via email, customers have full authority and responsibility for server administration. This includes handling malware, fixing software errors, managing disk space (to avoid full storage), and ensuring IP addresses do not get blacklisted.
Data Management (User Data)
All content uploaded, stored, created, or shared on the server (“User Content”) is fully the customer’s responsibility. Customers must ensure their data complies with Vietnamese laws and the service usage policy.
Responsibility for Sub-Users
If customers grant access to others (employees, partners, agents, etc.), all actions by those users are considered customer actions. All prohibitions apply equally to sub-users.
Understanding these responsibilities is essential to maximizing service performance and efficiency. The next section outlines prohibited actions on VinaHost’s infrastructure.
2. Prohibited Activities
To ensure system stability, maintain IP reputation, and protect customer interests, VinaHost strictly prohibits the following types of abuse.
These rules help protect VinaHost’s infrastructure and maintain overall service quality.
2.1. System and Network Abuse
Causing abnormal or excessive load on VinaHost’s infrastructure, such as continuously running applications that consume excessive system resources (CPU, bandwidth, disk I/O), especially if they affect system performance.
Specific note: If CPU usage remains excessively high for 180 minutes and shows signs of system impact, the VPS will be considered compromised and CPU may be limited to 25% per hour.Attempting to interfere with the normal operation of other customers’ services or VinaHost’s network.
Bypassing or attempting to bypass security mechanisms, firewalls, or access restrictions set by VinaHost.
Using the service for unauthorized spam or auto-responders, including bulk emails or unsolicited automatic responses.
Unauthorized scanning or crawling of VinaHost systems.
Spreading, storing, or enabling the distribution of malware (virus, trojan, botnet, keylogger, DoS/DDoS, etc.).
Using any IP address not officially assigned by VinaHost.
2.2. Illegal or Harmful Content
Storing, sharing, or distributing illegal content, fraud, threats, harassment, defamation, or violations of personal privacy.
Transmitting or storing pornographic material or any content prohibited by Vietnamese law.
Impersonating individuals or organizations, including VinaHost staff or representatives.
Unauthorized disclosure of others’ personal or financial information.
2.3. Email and Communication Abuse
Bulk email sending is only allowed when fully compliant with:
Proper configuration of SPF, DKIM, PTR, and DMARC.
A verified mailing list using double-opt-in, ensuring recipient consent.
Clear and transparent unsubscribe options in all outgoing emails.
Any action that may cause server IPs or VinaHost IP ranges to be blacklisted (e.g., Spamhaus, Sorbs) is strictly prohibited.
2.4. Legal and Intellectual Property Violations
Infringing copyrights, trademarks, patents, or trade secrets.
Participating in or supporting money laundering, fraud, financial crimes, or other illegal activities.
Violating Vietnamese laws or international agreements applicable to Vietnam, including sanctions or trade restrictions.
Compliance with these rules is mandatory to ensure a safe and efficient system.
3. Data Backup Policy
Data backup is essential for ensuring data integrity and recoverability against unforeseen risks including system errors, hardware failures, cyberattacks, or human mistakes. VinaHost clearly states that customers bear the primary responsibility for their data protection.
Based on internal policies and industry standards, the following points apply:
Customer Responsibility
Customers are fully responsible for establishing and maintaining their own backup procedures.
Liability Disclaimer
VinaHost is not legally responsible for any data loss or corruption resulting from the customer’s failure to perform adequate and regular backups.
Enhanced Data Protection
Customers are strongly encouraged to maintain independent off-site backups even when using VinaHost backup services.
Backup Options and Limitations
VinaHost does not provide individual backups for each website or application inside VPS/Cloud servers.
Low-cost plans (e.g., CheapSSD) may not include free backups. Customers using these plans must handle backups themselves or subscribe to paid backup addons.
We highly recommend regular backups via Control Panel (if available), FTP/SFTP, or dedicated services such as VinaHost Cloud Backup.
4. Violation Handling Process
VinaHost reserves the full right to take necessary actions to protect the system, the user community, and company reputation when any service violations are detected. Measures depend on the severity of the violation:
Warning and Remedial Action
For first-time or lower-severity violations, VinaHost will issue an official notice (via email or support system) requesting customers to stop the violation and take corrective action within a specified timeframe.
Resource Limitation:
VinaHost may limit VPS CPU resources if abusive resource usage affects system stability.
Service Suspension
Immediate suspension may occur, with or without prior notice, in cases such as:
Severe violations (malware distribution, DDoS, phishing, etc.)
Repeated violations after warnings
Excessive abuse causing negative impacts on other customers’ service quality
Permanent Termination
VinaHost has full authority to permanently terminate services if customers commit serious violations, refuse to cooperate, or break any applicable laws.
Financial and Data Consequences
If services are terminated due to violations:
Paid service fees will not be refunded.
VinaHost may permanently delete all related data and bears no responsibility for data loss.
VinaHost is committed to delivering secure, stable, and high-performance VPS/Cloud Server services.
